Private Investigators and Judgment Recovery

Private Investigators and Judgment Recovery

First off, what exactly is judgment recovery? The definition is fairly simple. It is the process of collecting money from debtors who have been commended to pay a creditor by a court. The process of actually collecting that money can sometimes not be simple at all, however.

If you’re ever awarded a judgment in a case, you may think, “Cool, I just won!” But a court judgment is only an official note stating that a debt is owed by law. The court is not responsible for actually collecting the money owed or making sure you are able to collect the money. You might be shocked to learn that up to 80% of judgments in America are never collected. Why? The debtor may hide their assets, refuse to pay or try to disappear to avoid payment. If you’re owed money, especially if it’s a large amount, this is incredibly frustrating. That’s where a private investigator comes in. A private detective with judgment recovery experience can track down the debtors and, in many cases, can uncover hidden assets to recover the debt that is owed.

So a private detective can track down a debtor and determine that they have the assets to pay what you are owed, but what if they refuse? You may be stumped, but a private detective knows the various legal tools that are available for use in order to recover the money. Garnishment of wages, forced sale of assets, repossession, seizure of bank accounts and evictions are some of the ways in which a debtor can be forced to pay up. A private investigator is invaluable for getting the information you may need to take this kind of action. They also have access to resources that allow them to quickly and accurately locate missing people or assets.
